Seller Terms

Kind Shop is a very unique marketplace. Our seller Code of Conduct must always reflect our values and ethos so a positive, supportive community is essential to help and encourage sellers to be successful. In order to uphold our code of conduct, we ask that our KINDpreneurs adhere to the following:

1. BE HONEST ABOUT YOUR VALUES

Our conscious shoppers are important to us. They buy safe in the knowledge they are supporting every KINDpreneur make the world a better place. Therefore, the values stated in your values story (in your shop settings) plus the values selected when listing your products must be correct. If you change your policies, method of production or business owners, you must email Hello@KindShop.co.uk 30 days prior to the change, to ensure your business and products still qualify for a shop on the site. You must also update your values story and any products affected by the change immediately, to ensure they are correct and do not contain any false, inaccurate or misleading information.

2. BE SUPPORTIVE & KIND

In order to promote a healthy and supportive community and marketplace, we expect our sellers to be kind and communicate in a supportive and non-discriminatory manner with customers, fellow KINDpreneurs, experts and owners of Kind Shop. Our community group the ‘Kind Club’ on Facebook, is provided as a support network for friendship with other KINDpreneurs and our Experts and to share information and advice.

The following behaviour, is therefore not permitted:

1. No personal attacks
2. No “calling out” (identifying someone you are claiming to have breached the terms of use)
3. No racist, sexist or hateful content or rants
4. No spam or promotion of other competitor services
5. No vulgarity or swearing
6. No “trolling”
7. No defamation of others
8. No bringing KINDpreneurs into disrepute

If anyone is found to be behaving in ways described above, their shop may be suspended or deleted and their content removed along with removal from our Kind Club.

3. BE RESPONSIBLE FOR YOUR OWN SUCCESS

We challenge you to immerse yourself in everything that’s on offer through your online shop, Kind Club community group and Kind Classes. Kind Shop is here to empower you to create and grow your business while impacting the world for good. We can advise and support you, but ultimately creating sales and running your ‘force for good’ business is in your hands. Creating purposeful products and services is only part of the process, networking, promoting and running a business etc are all important too. You will find lots of helpful topics in our Kind Classes.

4. BE RESPECTFUL

Please don’t use Kind Shop or Kind Club to promote products for sale on other platforms (eg Etsy, your own website). Please support the site by shouting loud and proud about Kind Shop (you are of course welcome to sell anywhere). Do not link to your own website or other selling platform either in your shop, product listings or posts/comments within our Kind Club. Kind Shop primary purpose is a marketplace to sell your items from our website and must not be used as a lead generation or marketing tool to direct customers elsewhere. You can however add your social network links to build your following in your shop settings. 

If selling to fellow KINDpreneurs, all sales must go through the KindShop.co.uk.

Do not use Kind Shop website, community or social media accounts to entice our sellers to join another selling platform or your own marketplace.

5. PROHIBITED ITEMS FOR SALE

1. Products which infringe copyright or trademark 
2. Adult or pornographic products 
3. Hazardous or dangerous products (weapons, knives, chemicals, nicotine etc)
4. Products gained illegally or stolen
5. Illegal items (e.g. drugs)
6. Food, Toys or Cosmetics without the necessary license
7. Products not designed or manufactured by you or the business you are representing on the Kind Shop. The exception being boxes or sets that contain items from other sellers that meet our Kind Shop values.

6. PRODUCT SAFETY REGULATIONS

Sellers of certain products must comply with the relevant UK product legislation:

7. SELLING FEES

Membership Option:
£12/month, Zero Commission, Zero Listing Fees, Unlimited Products, No Tie In.

OR

Commission Option:
15% Commission, No Monthly Fee, Zero Listing Fees, Unlimited Products, No Tie In.

Payment Gateway Fees (both options):
Stripe: 1.4% + 20p per order. Paypal: 2.9% + 30p.

Your shop includes access to the Kind Club and to all our knowledge base in the Kind Classes. 

8. YOUR FUNDS

You will receive your funds immediately after your customers purchase, either into your Paypal or Stripe account (if paid by card). Stripe will automatically transfer funds to your bank account 7 days later and Paypal allow you to withdraw instantly. There may be an occurrence where Paypal hold your money for a period of time, if you are a new Paypal user or if you have unusual activity on your account, but that is outside of our control and Paypal will lift their restrictions after several sales. Please note: entering an incorrect Paypal email in your settings will mean you will not receive your funds, Kind Shop are not liable for any lost funds due to your error.

9. PRODUCTION METHODS

We expect all KINDpreneurs to use ethical and sustainable methods of production. You must meet or be working towards some of the UN Sustainability Goals.

10. POSTAGE

You are responsible for posting items to customers directly. This must be within the time frame specified in your shop settings and/or listing. If, for whatever reason, you are unable to do so, you must inform your customer and email Hello@KindShop.co.uk within 48 hours.

11. PACKAGING

Sellers must use earth friendly packaging for all orders. This MUST be plastic free. Please consider using biodegradable, compostable or re-using packaging materials (as long as no plastic tape is used).

12. RETURNS / EXCHANGES / REFUNDS / REPAIRS

By using our service, all sellers agree to abide by the Consumer Protection (Distance Selling) Regulations 2000. This law protects the consumer when buying online. Kind Shop make it easy for sellers to comply by providing a returns policy template found in your Kind Classes, however, compliance to the distance selling law is the responsibility of the seller. 

The Consumer Protections Regulations are summarised below:

Return Address: Sellers must complete their address in their shop settings (even if this is your home address). Customers have a legal right to this information and it is not optional. If you don’t provide it you are trading illegally.

14 Day No Quibble Return Policy: Customers have a right to return the product(s), even if not faulty (they do not need to give a reason), up to 14 days after receipt of the items and a full refund (including the cost of the outgoing postage) must be made to the customer within 14 days of the seller receiving the returned product(s), or within 14 days of the customer providing evidence that the product(s) have been returned (e.g. proof of postage), whichever is sooner. Unless the seller has stated otherwise, the customer is responsible for paying for the cost of return postage. Sellers must provide a return address in all packages. 

6 Month Warranty: Customers have a right to return products if they develop a fault within 6 months of receipt. Depending on the circumstances, they may be entitled to a refund (full or partial), repair or replacement.

Sale Products: Customers have exactly the same rights to refunds when they buy items in a sale as when they buy them at full price.

Excluded products: Unless faulty, the following types of products are non-refundable: Personalised, bespoke or made-to-order products (if they cannot easily be resold), products which deteriorate quickly (e.g. food), personal items with a hygiene seal (cosmetics, underwear) where the seal is broken and downloadable products.

Lost items: If the item is lost in transit then, unless proven otherwise, the seller must provide a refund or deliver the same item.

13. CUSTOMER DATA AND PRIVACY

To run a shop on KindShop.co.uk you must have a GDPR Privacy Policy added to your shop settings. If you need help to create one, you can find a privacy policy template for you to modify in our Kind Classes.
When you receive orders via Kind Shop, you will receive a buyer’s email address or other information as a result of entering into a transaction with that buyer.
You must not contact customers for any other purpose other than to post their Kind Shop orders, update them on Kind Shop orders or respond to a query asked in the ‘Ask a Question’ form or your Contact Form in your shop.
You must not collect customer data or add to your email or physical mailing list without their express consent.

14. YOUR INTELLECTUAL PROPERTY

All content uploaded to KindShop.co.uk remains your intellectual property. Your content (photos, product names, descriptions, downloads, audio and video) must be your own and not owned by others unless you have a license to do so. By uploading to the site, you are giving rights and license for KindShop to use, edit, modify and make available to the public, your content, for your benefit, to market your business and your products/services. This will be for (but not limited to) both online and offline publications (for example: adverts, blog posts, social media posts, marketing materials, press releases, magazines, newspapers, books etc) with the sole purpose of helping you gain more business. 

Your content must not infringe any law and indemnifies Kind Shop against all legal fees, damages and other expenses that may be incurred as a result of your breach of the above. 

15. OUR INTELLECTUAL PROPERTY

You must not copy or modify Kind Shop branding, or other content from the site, without our express consent. Whilst you are a KINDpreneur and subscribe to a shop, you have authority to add your KINDpreneur and/or Kind Shop badge to your website and other media. However, if you decide to leave, or we sadly have to remove you for breaking these terms, you will be expected to remove any KINDpreneur or Kind Shop branding from your site or other media. Previous social posts can remain. 
If you wish to sell Kind Shop merchandise, you can only do so if you have been given express permission.

16. OUR LIABILITY

KindShop.co.uk will not be liable for:
Loss of data
Loss of revenue or profits
Loss of sales or opportunities
Loss of goodwill or reputation

17. MEMBERSHIP CANCELLATIONS BY YOU

There is no tie in and you can cancel at any time. You will have access to your shop till the day before your next normal payment date, when your subscription will automatically end. No refunds given for any time not used, as you will be able to use your shop until the day before your next payment was due.

18. MEMBERSHIP CANCELLATIONS BY US

To use our service (Your Shop, Kind Club and Kind Classes) you must subscribe to our membership. Shops not subscribed will be unable to edit or add products and will be cancelled within 7 days. We appreciate that payments may fail and you may be going through a difficult time. In which case please contact us asap via Hello@KindShop.co.uk so we can support you by pausing your shop for up to 2 months. 

Kind Shop reserve the right to remove any product listings or delete your account and content without notice at any time if you violate the above Terms. In most cases we will endeavour to give you notice, unless we acknowledge that your actions or content may be harmful. Kind Shop reserved the right to terminate or change the service for any reason at any time without notice.

19. UPDATES TO OUR TERMS

From time to time we will update our seller terms which will be posted here online. Please review these terms regularly to ensure you are aware of any changes. Your continued use after changes are updated means you agree to be legally bound by these terms.
